Description

Written by the top expert on patent law, this reference tool provides rapid access to every Federal Circuit patent decision, and contains concise summaries of all patent decisions of the U.S. Court of Appeals for the Federal Circuit. This publication combines the pertinent statutes, rules and case authority on United States patent law and procedure. Updated annually, it features a topically arranged outline with summaries and explanations of the published decisions of the United States Court of Appeals for the Federal Circuit, rendered from 1982.

For this 2007 Edition, the cut-off date for Federal Circuit decisions is the end of December 2006 but the three 2007 Supreme Court decisions are also included due to their significance. First was a decision on jurisdiction in licensee-initiated suits for a declaratory judgment on a patent's validity and infringement--MedImmune, Inc. v. Genentech, Inc., 2007 U.S. LEXIS 1003 (2007). Second was a decision on the export of software on a master disk as an infringement under 35 U.S.C. Section 271(f) (unauthorized exports of components of patented combinations)--Microsoft Corp. v. AT & T Corp., 2007 U.S. LEXIS 4744 (2007). Third was a decision on the "teaching, suggestion, motivation'' test for the obviousness standard of patentability--KSR International Co. v. Teleflex Inc., 2007 U.S. LEXIS 4745 (2007).

In addition to abstracts of the Supreme Court’s “Markman,” “Warner-Jenkinson,” “Pfaff” and “ Festo” decisions, the Digest also includes the following items:

  • A cross reference table that matches the Digest’s Topical Outline’s paragraph numbers with the Chisum on Patents Treatise’s chapter and section numbers
  • A case chronology that serves to spot new trends in patent law
  • A case table with full citations that helps locate cases and find the correct citation
  • An Index to the topically arranged abstracts in Part 1.

Also sold as Volumes 11-17 of Chisum on Patents. Paperbound; updated annually.
